What is a Power of Attorney?
A Power of Attorney is a document in which one person or corporation (the Donor) appoints someone (the Attorney) to act for and on behalf of him or her or the corporation.
Power of Attorney may be required when, for example, if you are going to be out of the country/place for a lengthy period of time, you might want someone to handle the affairs for and on your behalf while you are not in the country or place where the affairs have to be handled.
Typical situations when Power of Attorney are required :
1) property sale and purchase 2) property leasing and receipt of rental payment and payment of expenses 3) setting up companies or open bank accounts or tax payment accounts 4) instructing lawyers to file or conduct court cases or legal actions for you
What if my Power of Attorney will have to be used in a foreign country ?
If your document is intended to be used in a foreign country (outside HK e.g in Spain, Vietnam, etc etc), you may have to have the power of attorney notarized by our notary public.
This is a process whereby our notary public witnesses the signature of the Donor on the power of attorney is authentic and genuine, and the donor has the capacity to make the power of attorney.
Some receiving countries of the power of attorney may also require apostille or legalization at the consulate of the receiving country in HK after the power of attorney has been notarized.
