Terms and Conditions for Online Marketplace

An online marketplace is a type of e-commerce site or platform where product or service information is provided by multiple third parties. The consumer transactions are processed by the marketplace operator and then delivered and fulfilled by the participating retailers or wholesalers.

It is necessary to have proper Terms and Conditions (T & C) for the website or platform for the following purposes for the smooth operation of the online marketplace:

1. Identify the relationship between the operator and the consumers
    
2. Specify the responsibilities of each party involved in the transactions
    
3. Provide description of what the marketplace offers and the role of the operator in the marketplace
    
4. Set out Privacy Policy of the platform or website as personal information of the users of the online marketplace will be collected during the booking or transaction process
    
5. Set out Payment Terms and Payment Structure, e.g. by charging a fee or commission whenever a customer purchases a product or service or making a booking for service through the online marketplace.
   
   The operator can organize payment through payment agent like PayPal etc as payment agent is required to operate under licences and comply with specific rules and regulations for their functions
    
6. For Limitation of Liability: There should be clauses to limit the liability as an online marketplace operator if someone wants to bring a claim against you
    
7. Provide Disclaimer e.g. on responsibility; background checks or guarantee or warranty of products or services provided by sellers /suppliers/ third party
