Rights & benefits of Patent Owner
There are various rights and benefits available for a patent owner :
1. The right to grant a licence to another person to use your patent to manufacture your invention, in return for royalties and other payments
2. The right to sell your patent for payment
3. The right to mark your product and its packaging as being patented. If you have applied for a patent and the application is pending, you may mark your product, and its packaging, to indicate that a patent is pending, for example, by using the phrase ‘Patent pending’. This could be a useful marketing strategy.
But when the patent application is subsequently withdrawn, you have to stop claiming such application in respect of your product or its packaging or else such inaccurate or false claim may be subject to both civil and criminal sanctions.
4. With the possible commercial benefits brought a registered patent, this encourages patent owner to continue the research, to develop new and innovative products, exploit new technology and promotes the transfer of technology within and outside Hong Kong
5. The right to take legal action against the unlawful manufacturing, using and/or selling your invention without your permission and against the infringement of your patent
